Who Is Placed in Removal Proceedings?

A non-citizen may be placed in immigration court for many reasons, including:

  • Entering the U.S. without inspection
  • Overstaying a visa
  • Committing certain criminal offenses
  • Violating the terms of a visa or immigration status
  • Denial of an immigration application filed with USCIS
  • Being stopped at the border and refused entry
  • Being arrested by immigration authorities (ICE)

When this happens, the Department of Homeland Security issues a Notice to Appear (NTA), which officially begins the removal process.

How Removal Proceedings Work

1. Master Calendar Hearing

This is your first court appearance. The judge will review the charges and ask whether you admit or deny them. You may also identify the type of relief you plan to pursue.

2. Filing Applications for Relief

Applications may include asylum, cancellation of removal, waivers, or adjustment of status.

3. Individual (Merits) Hearing

This is your full trial. You present testimony, evidence, witnesses, and legal arguments. The judge will decide whether you must leave the United States or may remain legally.

This is where having an experienced attorney matters most.


Common Defenses & Forms of Relief

Every case is unique, but common forms of relief include:

  • Asylum, Withholding of Removal & CAT Protection
    For individuals who fear persecution or serious harm in their home country.
  • Cancellation of Removal (Non-LPR & LPR)
    Available to certain long-term residents who meet strict legal requirements.
  • Adjustment of Status / Green Card Eligibility
    For individuals with qualifying family or employment petitions.
  • Waivers of Inadmissibility
    For certain criminal, immigration, or fraud-related issues.
  • Prosecutorial Discretion / Administrative Closure
    In some cases, the government may agree to close or terminate proceedings.
  • Termination of Proceedings
    If the government cannot prove its case or the NTA is legally defective.

Appeals to the BIA & Federal Courts

If an immigration judge denies your case, you may have the right to appeal. Many individuals succeed on appeal when their case is properly prepared.

Appeals are governed by strict rules and deadlines. A single mistake can permanently eliminate your right to appeal. This is why experienced legal representation is critical at this stage.
